These Terms of Use (“Terms”) govern your use of the Safari Spotter mobile application (“the app”).

By downloading or using Safari Spotter, you agree to these Terms. If you do not agree, please do not use the app.

1. Who May Use the App

Safari Spotter is designed for families and general audiences.

Children under 13 may use the app with parental or guardian guidance and supervision.

By using the app, you confirm that you have the legal capacity to enter into these Terms or that you are using the app with appropriate parental or guardian consent.

2. Your Content

You may create and store content within the app, including:

  • Wildlife sightings

  • Notes

  • Photos

  • Location tags

You retain ownership of all content you create.

You are solely responsible for:

  • The accuracy of what you record

  • Ensuring you have permission to take and store photos

  • Ensuring your use of the app complies with park rules and local laws

Safari Spotter does not claim ownership of your content and does not upload it to our servers.

3. Acceptable Use

You agree not to:

  • Use the app for unlawful purposes

  • Attempt to reverse engineer, decompile, or interfere with the app

  • Use the app in a way that harms wildlife, other visitors, park property, or public safety

  • Circumvent device or platform security protections

We reserve the right to restrict access if the app is misused.

4. Safety and Wildlife Disclaimer

Safari Spotter is a recording and educational tool.

It is not:

  • A navigation system

  • A safety device

  • An emergency service

  • A real-time wildlife alert system

You remain fully responsible for your conduct in parks and wildlife areas.

Always:

  • Follow official park rules

  • Obey speed limits and signage

  • Follow ranger instructions

  • Avoid using your phone while driving

Wild animals are unpredictable. Safari Spotter accepts no responsibility for incidents occurring during wildlife activities.

5. Maps and Third-Party Data

Safari Spotter may use map data from OpenStreetMap and related services.

Map data may be:

  • Incomplete

  • Outdated

  • Inaccurate

We do not guarantee the accuracy, completeness, or availability of map or location information.

Use maps as a general reference only.

6. Notifications

If enabled, Safari Spotter may schedule local notifications on your device.

  • Notifications are generated locally.

  • No remote push system is used.

  • You may disable notifications in your device settings at any time.

7. Availability and Updates

We may:

  • Update the app

  • Modify features

  • Fix bugs

  • Improve functionality

  • Remove features

We do not guarantee:

  • Continuous or uninterrupted availability

  • That all features will remain permanently available

  • Compatibility with all devices or operating system versions

App stores may also control availability in certain regions.

8. Intellectual Property

All intellectual property rights in the app — including branding, design, interface elements, text (excluding user content), and software — belong to Safari Spotter App or its licensors.

You may not:

  • Copy or redistribute the app

  • Modify the software

  • Use branding without permission

All rights not expressly granted are reserved.

9. Disclaimer of Warranties

To the maximum extent permitted under South African law, the app is provided:

“As is” and “as available.”

We make no warranties or representations that:

  • The app will be error-free

  • The app will always be available

  • Information provided is fully accurate

  • The app will meet every user’s expectations

Nothing in these Terms excludes rights you may have under applicable consumer protection laws that cannot legally be excluded.

10. Limitation of Liability

To the maximum extent permitted by law, Safari Spotter App will not be liable for:

  • Indirect, incidental, special, or consequential damages

  • Loss of data

  • Device damage

  • Personal injury arising from misuse of the app

  • Wildlife-related incidents

  • Loss arising from reliance on map or location information

Our total liability, where liability cannot be excluded, is limited to the extent permitted under applicable law.

Nothing in these Terms limits liability where it cannot legally be limited under South African law.

11. Indemnity

You agree to indemnify and hold Safari Spotter App harmless from any claims, damages, or losses arising from:

  • Your misuse of the app

  • Your violation of these Terms

  • Your unlawful conduct while using the app

12. Termination

You may stop using the app at any time by uninstalling it.

We may suspend or restrict access if:

  • These Terms are breached

  • The app is misused

  • Required by law

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.

14. Changes to These Terms

We may update these Terms from time to time.

If material changes are made, we will update the effective date above. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.
